America's Second Treaty with Britain

If you have an interest in international relations, American history in the 1780s and 90s, or Anglo-American relations, then Jay's Treaty by Samuel Flagg Bemis should be on your reading list.

The book presents the diplomatic situation among the US, Britain, and France from the 1783 treaty ending the Revolutionary War to the conclusion of Jay's Treaty in 1794. In addition to British recognition of American independence, the 1783 treaty provided for:

* American control of the region roughly bounded north of the Ohio River, south of the Great Lakes, and east of the Mississippi River
* British evacuation of five forts located in the above territory on the Great Lakes or St Lawrence River
* British restoration or compensation for American slaves carried away by British troops
* Repayment of American debts to British creditors

By the early 1790s, none of the above treaty provisions had been satisfied. In addition:

* British forces at Detroit (one of the five forts on US territory) had rebuilt and occupied an additional fort south of Detroit
* British officials were seeking to establish trade agreements directly with Americans in the western territories and the new state of Vermont with the goal of detaching these territories from the United States
* British officials were supplying arms to Indian tribes in US territory between the Ohio River and Great Lakes, encouraging conflict between the Indians and American settlers in that area
* Simultaneously, the British proposed to mediate the US conflict with the western Indian Tribes on the basis of creating a neutral buffer state between the US and Canada, carved out of the US territory between the Ohio and Great Lakes
* Finally, after war had broken out between Britain and Republican France, the British redefined "contraband" to include food as well as military items and seized several American ships carrying food to French islands in the Caribbean

Needless to say, many Americans, especially those supporting the party then forming around Jefferson, felt that these British provocations could lead to war. The situation was complicated by Jefferson's role as Secretary of State in Washington's first administration (1789-93) and the leading American Francophile. The situation was further complicated by the fact that Hamilton, the Secretary of the Treasury, primary confidant of President Washington, and the leading Anglophile in America, was in direct contact with the British minister to the US, bypassing the Secretary of State.

In the treaty of 1794, John Jay negotiated solutions to most of the issues listed above and prevented (at least until 1812) another war with Britain, one that the US was probably too weak to have survived in the 1790s. There has been some debate on whether Jay could have extracted more concessions from Britain, but that seems doubtful, especially since the British were reading his coded correspondence and knew the US bargaining position.

Originally published in 1923, a revised 1965 paperback edition of Jay's Treaty can be found used. The language of Bemis' text is slightly archaic while that of the quoted source document is even more so. Still, the book is well worth the effort for those interested in the subject matter.
